Terms and Conditions of Sale

Last updated: October 2026

1. Seller identity

The website www.inesdelafressange.fr (the “Website”) is operated by IDLF SA, a French public limited company (société anonyme) with share capital of €61,164.50, whose registered office is at 10 rue du Mail, 75002 Paris, France, registered with the Paris Trade and Companies Register under number 792 301 806, intra-community VAT number FR67 792 301 806 (“IDLF” or “we”).

Publication director: Fabrice Boé.

Customer Service: IDLF SA – Service Clients Web, 10 rue du Mail, 75002 Paris, France – contact@inesdelafressange.fr – +33 9 72 27 67 05.

Website hosting: Shopify (see the legal notice).

2. Purpose and scope

These Terms and Conditions of Sale (the “Terms”) govern sales of products (the “Products”) concluded on the Website between IDLF and any natural person acting for purposes outside their commercial, industrial, craft, professional or agricultural activity (the “Customer” or “consumer”).

The applicable Terms are those in force on the date of the order. The Customer reads them before the contract is concluded and expressly accepts them when placing the order. IDLF may amend them for the future; orders already placed remain subject to the Terms accepted at the time of the order.

3. Products and pre-contractual information

Before ordering, the Customer has access on the Website to the essential information about the Products, in particular their main characteristics and price. Photographs and representations are for illustrative purposes; IDLF endeavours to present the Products as faithfully as possible.

Offers are valid for as long as they are visible on the Website and while stocks last. If a Product becomes unavailable after the order, IDLF informs the Customer as soon as possible and refunds the amounts paid for that Product.

Before the contract is concluded, the Customer also receives the information required by the French Consumer Code (Code de la consommation): IDLF’s identity and contact details, total price, payment and delivery costs and terms, delivery date or timeframe, legal guarantees, the right of withdrawal and how to exercise it, the cost of returning the Products, and the option of referring a dispute to a consumer mediator.

4. Orders

4.1 Ordering process

The Customer selects the Products, adds them to the basket and follows the ordering steps. Before final confirmation, the Customer can check the order details and total price and correct any errors.

The order is concluded when the Customer clicks the confirmation button labelled “Order with obligation to pay” (or an equivalent unambiguous wording), after accepting these Terms.

4.2 Order confirmation

IDLF sends the Customer, on a durable medium (email), confirmation of the order, together with these Terms, the model withdrawal form and information on the right of withdrawal, return conditions and consumer mediation. The Customer is advised to keep this message.

4.3 Refusal of orders

IDLF may refuse an order for a legitimate reason, in particular where the Product is unavailable, in case of fraud or attempted fraud, or where there is a previous payment dispute.

5. Prices

Prices are shown in euros, inclusive of all taxes where French VAT applies, excluding delivery costs. Delivery costs are shown before the order is confirmed, together with the total price payable.

For deliveries outside the European Union, customs duties, local taxes or import charges may be payable. Before payment, the order summary states whether these amounts are included in the price or remain payable by the Customer.

The price invoiced is the price displayed and accepted at the time of the order.

6. Payment

Payment is made using the payment methods offered to the Customer at the time of the order, including, depending on availability, bank card, Apple Pay, Google Pay, PayPal or payment in instalments with Alma.

Transactions are secured by the Website’s payment service providers. IDLF does not store the Customer’s full banking details, which are processed directly by those providers.

The order may be suspended or cancelled if payment authorisation is refused or payment is not completed. The Products remain the property of IDLF until the price has been paid in full.

7. Delivery

7.1 Delivery areas, costs and address

Products are delivered to the countries and territories offered on the Website at the time of the order, to the address given by the Customer, who is responsible for its accuracy. Delivery methods and costs are detailed in the Shipping Policy (www.inesdelafressange.fr/policies/shipping-policy).

7.2 Delivery times

Before the contract is concluded, the Website states the date or timeframe within which IDLF undertakes to deliver the Products. Failing that, IDLF delivers without undue delay and no later than thirty (30) days after the contract is concluded.

7.3 Late delivery

If IDLF fails to deliver by the agreed date or within the agreed timeframe, the Customer may ask IDLF to deliver within a reasonable additional period. If IDLF fails to deliver within that period, the Customer may terminate the contract by registered letter with acknowledgement of receipt or in writing on another durable medium. The Customer may terminate the contract immediately if IDLF refuses to deliver, or if the delivery date was an essential condition of the purchase. IDLF then refunds all sums paid no later than fourteen (14) days after termination.

7.4 Receipt

Risk passes when the Product is handed over to the Customer. On receipt, the Customer is advised to check the condition of the parcel and the Products and to report any anomaly, missing Product or damage promptly to Customer Service, or to the carrier by recording reservations. This recommendation does not limit the Customer’s rights under the legal guarantees.

8. Right of withdrawal

8.1 Withdrawal period

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) calendar days to exercise the right of withdrawal, without giving any reason and without paying any penalty.

This period runs from the day on which the Customer, or a third party other than the carrier designated by the Customer, takes physical possession of the Product. For an order of several Products delivered separately, the period runs from receipt of the last Product. If the period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

8.2 How to exercise the right of withdrawal

The Customer may exercise the right of withdrawal, at their choice:

  • using the online withdrawal function, available on the Website throughout the withdrawal period, by validating their statement with the “Confirm withdrawal” button;
  • by sending the model withdrawal form set out in the annex to these Terms;
  • by sending any other unequivocal statement of their decision to withdraw, by email to contact@inesdelafressange.fr or by post to IDLF SA – Service Clients Web, 10 rue du Mail, 75002 Paris, France.

It is sufficient for the statement to be sent before the period expires. The online procedure on the “Returns” page (www.inesdelafressange.fr/pages/retour) provides the return label, but using it is not a condition for exercising the right of withdrawal.

IDLF sends the Customer, without delay and on a durable medium, an acknowledgement of receipt of the withdrawal stating the content of the statement and the date and time it was sent.

8.3 Returning the Products

The Customer returns the Products without undue delay and no later than fourteen (14) days after communicating the decision to withdraw, to the following address: INES DE LA FRESSANGE – Entrepôt LOGISTIQUE NC, 17 avenue du Noyer à la Malice, 95380 Louvres, France.

Returns do not require the use of the original packaging. The Customer is advised to protect the Products during transport and, where possible, to include their labels, accessories and documents.

The Customer may handle and try on the Products as they would in a shop, in order to establish their nature, characteristics and functioning. The Customer is only liable for any diminished value of the Products resulting from handling other than what is necessary for that purpose (Article L. 221-23 of the French Consumer Code).

8.4 Return costs

For deliveries in France, IDLF provides a prepaid Colissimo return label: returning the Products costs the Customer nothing. For deliveries outside France, the direct cost of returning the Products, and the choice of carrier, are the Customer’s responsibility; the Customer is informed of this before ordering.

8.5 Refund

In the event of withdrawal, IDLF refunds the Customer all payments received for the order concerned, including the initial delivery costs corresponding to the least expensive standard delivery method offered by IDLF for the Customer’s delivery country. Additional costs resulting from the Customer’s choice of a more expensive delivery method are not refunded.

The refund is made without undue delay and no later than fourteen (14) days from the date on which IDLF is informed of the Customer’s decision to withdraw. IDLF may withhold the refund until it has received the Products back or until the Customer has supplied proof of having sent them, whichever is earlier.

The refund is not conditional on an inspection of the Products. It is made using the same means of payment as used for the order, unless the Customer has expressly agreed otherwise, and at no cost to the Customer. For an order paid in instalments, the refund cancels any instalments still to fall due.

If the returned Products show diminished value due to handling other than that described in Article 8.3, IDLF may deduct from the refund an amount proportionate to that diminished value, after informing the Customer and justifying the amount.

8.6 Exceptions to the right of withdrawal

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Products made to the Customer’s specifications or clearly personalised;
  • Products unsealed by the Customer after delivery which cannot be returned for health protection or hygiene reasons, such as beauty products and perfumes whose seal has been removed, and underwear and swimwear whose hygiene film has been removed.

No other category of Products is excluded from the right of withdrawal. Beauty products and perfumes that are still sealed, leather goods, accessories, jewellery, watches, stationery, books and canvas bags may be returned under the conditions of this article.

8.7 Exchange and gift voucher (commercial options)

In addition to the right of withdrawal, a Customer returning a Product may choose, if they wish, a size exchange (subject to stock availability) or a Gift Voucher equal to the value of the returned Products, excluding delivery costs, plus 10%. These options are offered on an optional basis only. If the Customer makes no express choice, or if the exchange Product is no longer available, IDLF issues a refund under the conditions of Article 8.5.

IDLF is liable for any lack of conformity existing when the Product is delivered and appearing within two years of delivery, under the conditions of Articles L. 217-3 to L. 217-20 of the French Consumer Code. For twenty-four months from delivery (twelve months for second-hand goods), any lack of conformity is presumed to have existed at the time of delivery, without the Customer having to prove it.

In the event of a lack of conformity, the Customer chooses between repair and replacement of the Product, unless that choice would entail disproportionate costs for IDLF. If the Product is not brought into conformity under the legal conditions, or in the other cases provided for by law, the Customer may obtain a price reduction or termination of the contract. Bringing the Product into conformity is free of charge for the Customer.

The legal guarantee of conformity applies independently of any commercial guarantee.

9.2 Guarantee against hidden defects

The Customer also benefits from the guarantee against hidden defects in the item sold provided for in Articles 1641 to 1649 of the French Civil Code. The Customer has two years from discovery of the defect to bring an action and may choose between termination of the sale and a price reduction.

9.3 Making a claim

To make a claim under a legal guarantee, the Customer contacts Customer Service (see Article 1). These provisions do not deprive the consumer of any mandatory right provided by law.

10. Complaints

In the event of any difficulty, the Customer is invited first to contact Customer Service by email at contact@inesdelafressange.fr or by post at IDLF SA – Service Clients Web, 10 rue du Mail, 75002 Paris, France, in order to seek an amicable solution.

11. Consumer mediation

In accordance with Articles L. 611-1 et seq. of the French Consumer Code, if a written complaint to IDLF has not been resolved, the consumer Customer may refer the matter free of charge to the consumer mediator responsible for IDLF, within one year of the written complaint:

CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice 49 rue de Ponthieu, 75008 Paris, France www.cm2c.net

The Customer may submit a request as set out on the CM2C website, including online. The mediator proposes a solution within ninety (90) days of notification of the referral. Mediation is free of charge for the Customer, except for any costs the Customer chooses to incur (for example, legal representation).

12. Personal data

IDLF processes the Customer’s personal data to manage the Website, orders, payments, deliveries, returns and customer relations, to meet its legal obligations and, where the law allows, for marketing and loyalty purposes. This processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (loi Informatique et Libertés).

The Customer has the right of access, rectification, erasure, objection, restriction and portability of their data, as well as the right to withdraw consent and to set instructions on what happens to their data after death. The Customer may exercise these rights by writing to contact@inesdelafressange.fr and may lodge a complaint with the CNIL (www.cnil.fr). Full information is available in the Privacy Policy, accessible in the Website footer.

13. Cookies

The Website uses cookies and other trackers. Trackers that are strictly necessary for the Website to function are placed without consent. Others are only placed or read with the Customer’s consent, which the Customer may give, refuse or withdraw at any time via the Website’s cookie management tool.

14. Governing law and disputes

These Terms are governed by French law, without prejudice to any more protective mandatory provisions available to a consumer residing in another country. In the event of a dispute not resolved amicably or through mediation, the competent courts are determined according to the applicable legal rules. No provision of these Terms deprives the consumer of the benefit of mandatory rules on jurisdiction.

15. Miscellaneous

If any provision of these Terms is held to be void or unenforceable, the remaining provisions remain in force to the fullest extent permitted by law. IDLF’s failure to rely on a provision at any given time does not constitute a waiver of the right to rely on it later. Computerised records kept in the systems of IDLF and its service providers may be used as evidence, without prejudice to the applicable legal rules.
